These Terms of Use govern the use of products and services provided by Mafaza Digital Solutions and establish the general framework of the relationship between Mafaza and the client. By using Mafaza’s services or purchasing any of its products, the client acknowledges that they have read and agreed to these Terms.
Scope of Services
Mafaza Digital Solutions provides specialized digital products, including Content Management Systems (CMS), websites, and related digital solutions. Products are developed to meet the needs of specific sectors and may be customized for the client according to the agreed scope of work, including visual identity, content, settings, and features included in the quotation or agreement.
Purchasing a product does not automatically include all future modifications, enhancements, or developments. Any additional work will be agreed upon separately.
Intellectual Property
The client retains ownership of the content, materials, data, and trademarks provided to Mafaza, unless otherwise agreed.
Mafaza retains all intellectual property rights related to the underlying software product, source code, software components, technical architecture, tools, and templates developed by Mafaza or for which Mafaza holds the relevant rights, unless the agreement with the client expressly provides for the transfer of specific rights.
The client is granted the right to use the purchased and delivered product in accordance with the agreed license terms and scope of the agreement. The client may not copy, resell, distribute, or use the software product to create a competing product without Mafaza’s prior written consent.
Payment and Delivery
Mafaza offers its products under a one-time payment model, with no monthly subscription or recurring fees for continued use of the product, unless the quotation or agreement specifies additional services subject to separate fees.
The one-time payment covers the items expressly stated in the quotation or agreement, such as the core product, agreed customizations, website setup, and any other specified deliverables.
Implementation begins after the required information, materials, and agreed payment have been provided. The quotation or agreement will specify the scope of work, expected implementation timeline, and delivery method.
Any additional requests or significant changes outside the agreed scope may result in additional costs or time. Such changes will be communicated to and approved by the client before implementation.
Limitation of Liability
Mafaza strives to provide its products and services to a professional standard appropriate to the agreed scope. However, certain services may depend on third parties, including hosting providers, payment service providers, domain registrars, email service providers, and other third-party services.
Mafaza shall not be liable for failures, interruptions, or losses directly resulting from services or systems outside its control, or from the client’s use of the product in a manner that violates applicable instructions or laws.
Mafaza does not guarantee specific commercial results, including visitor numbers, sales, or search engine rankings, unless a specific service or performance standard has been expressly agreed upon.
To the extent permitted by applicable law, Mafaza’s liability shall be limited to the scope of services and obligations expressly stated in the agreement with the client.
Governing Law
These Terms are governed by and interpreted in accordance with the laws and regulations of the Kingdom of Saudi Arabia. The competent courts of the Kingdom of Saudi Arabia shall have jurisdiction over any dispute arising from or relating to these Terms or the services provided, unless another lawful dispute-resolution method has been agreed upon.
Changes to These Terms
Mafaza may update these Terms from time to time to reflect changes in its products and services or applicable legal and regulatory requirements. The updated version published on the website shall take effect from its stated effective date, subject to any existing contractual obligations previously agreed upon.
